General terms and conditions (GTC) of Topdonshop.ch:
General
The general terms and conditions apply to all our contracts and services in the currently valid version. At the latest when products from our range are ordered, these General Terms and Conditions are deemed to have been accepted. The general terms and conditions (hereinafter referred to as "GTC") apply to all legal transactions that are concluded via the online shops www.topdonshop.ch and www.buyplus.ch (hereinafter referred to individually as "online shop"). Both online shops are operated by BuyPlus GmbH.
 
VAT & ARF fees included in the price
Unless specifically noted, the prices include the statutory value-added tax and the advance recycling fees (ARF). Prices are given in CHF (Swiss francs).
 
Terms of payment
Payment had to be paid in advance. Payment methods: Prepayment via e-banking, Post Finance, POST counter, PayPal, TWINT, VISA, MaterCard, cash collection. With the order, the customer undertakes to pay and accept. Any costs incurred as a result of non-compliance are to be borne by the customer.

Guarantee
We grant customers FROM Topdonshop.ch the full guarantee of the manufacturer. This is valid for 24 months from the date of the order number. We remain available for out-of-warranty repairs and can do them cost-effectively.


1.1 Scope of Warranty
The guarantee at Topdonshop.ch covers all ordered devices, such as mobile phones, tablets, car radios and car diagnostic devices, which no longer work properly within 24 months without the customer having to do anything. This also applies to items that arrive defective at the customer. Accessories such as rechargeable batteries, charging adapters, USB cables, headphones, SD cards, covers, foils, etc., as well as all free accessories that are included in the package as a promotion are excluded from the guarantee.
 
For failure and damage caused by external influences, accidental damage, changes made to the device, conversions, extensions, use of third-party parts, neglect, viruses or software errors, improper transport, improper packaging or loss when returning the device to Topdonshop.ch, Topdonshop.ch assumes no guarantee.
 
The guarantee is void if the defect in the device has arisen as a result of maintenance or repairs carried out by someone other than the official manufacturer of the device or Topdonshop.ch. The guarantee also expires if stickers or serial numbers of the device or a component part of the device have been changed or made illegible. If the repair turns out to be an error that is not covered by the guarantee, Topdonshop.ch reserves the right reserves the right to charge the customer for the costs incurred in the form of a handling fee and for the repairs that are subject to a charge for material and labor.
 
Errors caused by software updates from the manufacturer are not included in the guarantee. If functions are restricted as a result, these are no reason for a warranty service.
 

1.2 Procedure in case of a warranty claim
Please do not open a PayPal dispute in the case of a guarantee! Buyer protection only applies in the event of non-receipt or deviation from the item description, so the purchase price would not be refunded. Topdonshop.ch is only able to send a replacement device after the PayPal conflict has been resolved. First contact our support (verkauf@Topdonshop.ch). Never send a device back without first discussing this with our support. Our support will explain the further process to you in detail. Devices that are returned without notice cannot be accepted by us and can only be returned to you against payment of the shipping costs.
 
Before you send the device back, check exactly which part is defective. There are certain sources of error that should be ruled out, as they can be remedied quickly and easily with a software update or repairs in Switzerland. If the device does not start, for example, the battery should be charged first and a replacement battery requested if necessary. A defect in the USB socket on the device can usually be repaired quickly in Switzerland. be resolved. Software problems can sometimes be solved by flashing the original firmware.
 
Contact our support and they will explain the further process with you. Our support may ask you to take photos of the defect. These may be necessary to clarify the problem remotely. For easy editing, simply attach the resulting photographs to your email. Delivery conditions
Parcels up to 30kg are always sent by Swiss A Post or B-POST, letter post, depending on the product size and weight. Bulky packages and shipments weighing more than 30kg are sent with DHL Express. If the customer wants to use another delivery method, then the customer must inform us in writing by email after ordering.
 

Scope of delivery, delivery time and withdrawal
Orders are usually dispatched on the day payment is received. If a delivery is delayed beyond a delivery date guaranteed by Topdonshop.ch in writing, the customer can put Topdonshop.ch in default after an additional period of at least two weeks to be set by him in writing and after the unused expiry of a further reasonable grace period of at least one week subsequently withdraw from the relevant order. The customer is obliged to check the products delivered by Topdonshop.ch immediately after delivery for completeness and correctness and to notify Topdonshop.ch in writing of any damage, defects and complaints immediately after discovery, at the latest 7 days after delivery. IMPORTANT: If you notice obvious damage to the packaging upon receipt of our delivery, then have this damage confirmed in writing by the carrier.
 
For returns, we require that the defective part or device with a completed return form and a copy of the invoice with which the device was delivered is sent or delivered to Topdonshop.ch for replacement. The return is at the risk of the buyer and must therefore be packed carefully so that no further damage can occur during transport. Deliverycosts has to be paid by costomer. No new warranty periods come into force if parts, assemblies or entire devices are replaced. The warranty is limited exclusively to the replacement of the damaged parts. If there is no improvement after two repairs/rework of a defective item and if no other arrangement has been made between the seller and buyer (e.g. purchase price reduction), a conversion of the purchase contract (product return and purchase price refund by the seller) comes into effect.
 
Scope of delivery/completeness/functionality regarding vehicle-specific items Despite careful research, selection and testing of our devices, it may happen that a device cannot communicate with the vehicle as described and therefore cannot fulfill its function as described. This can happen, for example, if the vehicle manufacturer makes changes to the electronics or the adaptation within the same model series that we are not aware of. In such a case, contact us immediately, we always strive to find a solution for all cases, but cannot guarantee that we can offer a solution for every case.
 
Topdonshop.ch does not assume any costs for installation and removal costs, nor time and installation costs without prior agreement.


Disclaimer
Claims for damages of any kind are excluded unless we are responsible for the damage intentionally or through gross negligence. Never rely solely on the image from the rear-view camera, the announcement of the navigation voice
or other technical aids. Topdonshop.ch does not assume any costs, neither for the installation and removal nor for time and installation expenses of devices. Under no circumstances are we liable for consequential damage or indirect damage (e.g. lost income due to the failure of one of our products).
 
Claim for damages
Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved. Any liability for consequential damage resulting from the use of the products is rejected.
 
Road Traffic Act guidelines
The buyer must be responsible for how he uses our products, allows or does not allow them. The buyer must comply with the generally applicable road traffic laws. In the case of violations of the law, Topdonshop.ch assumes no responsibility for the costs incurred. Topdonshop.ch rejects any liability for legal violations caused, this also applies to articles where it was not expressly pointed out.
 
Any duplication, distribution or other use is prohibited and only permitted with the express and written consent of Topdonshop.ch. Topdonshop.ch reserves the right to take any legal action if this requirement is violated.
